Insurance companies are denying insurance due to pre-existing conditions – a violation of the law or a trick?

The Affordable Care Act is clear that as of 2014, people cannot be denied coverage due to pre-existing conditions. Interestingly, HealthCare Advocates has been receiving calls from people that are being denied coverage for pre-existing conditions. What is the gimmick you ask? It is still 2013 and the law does not take effect until 2014. This allows the insurance companies to deny undesirable members up and until January 1, 2014.

Of course most people would think, “doesn’t the insurance company have to tell me this or suggest that I apply in 2014?” While it would seem like the decent thing to do, the insurance companies may deny people coverage based on pre-existing conditions up until January 1, 2014. If you have a pre-existing condition, just apply after the 1st of the year.
